Slavery and the eight veils

Over the last several years I have evolved and discarded several theories in an attempt to explain why it is that most people cannot see truth -- even when it smacks them in the face. Those of us who can see “the conspiracy” have participated in countless conversations amongst ourselves that address the frustration of most peoples' inability to comprehend the extremely well-documented arguments which we use to describe the process of our collective enslavement and exploitation. The most common explanation to be arrived at is that most people just “don't want to see” what is really going on.
Extremely evil men and women who make up the world's power-elite have cleverly cultivated a virtual pasture so grass green that few people seldom, if ever, bother to look up from where they are grazing long enough to notice the brightly colored tags stapled to their ears.
The same people who cannot see their enslavement for the pasture grass have a tendency to view as insane “conspiracy theorists” those of us who can see the past the farm and into the parlor of his feudal lordship's castle.
Finally, I understand why.
It's not that those who don't see that their freedom is vanishing under the leadership of the power-elite “don't want to see it” -- they simply can't see what is happening to them because of the unpierced veils that block their view.
All human endeavors are a filtration process. Sports is one of the best examples. We play specific sports until we get kicked off the playground. The pro athletes we pay big bucks to watch just never got kicked off the playground. Where millions of kids play little league each spring, they are filtered out until there are about 50 guys who go to the World Series in October.
Behind the first veil: There are over six billion people on the planet. Most of them live and die without having seriously contemplated anything other than what it takes to keep their lives together. Ninety percent of all humanity will live and die without having pierced the first veil.
The first veil: Ten percent of us will pierce the first veil and find the world of politics. We will vote, be active and have an opinion. Our opinions are shaped by the physical world around us; we have a tendency to accept that government officials, network media personalities and other “experts” are voices of authority. Ninety percent of the people in this group will live and die without having pierced the second veil.
The second veil: Ten percent of us will pierce the second veil to explore the world of history, the relationship between man and government and the meaning of self-government through constitutional and common law. Ninety percent of the people in this group will live and die without having pierced the third veil.
The third veil: Ten percent of us will pierce the third veil to find that the resources of the world, including people, are controlled by extremely wealthy and powerful families whose incorporated old world assets have, with modern extortion strategies, become the foundation upon which the world's economy is currently indebted. Ninety percent of the people in this group will live and die without having pierced the fourth veil.
The fourth veil: Ten percent of us will pierce the fourth veil to discover the Illuminati, Freemasonry and the other secret societies. These societies use symbols and perform ceremonies that perpetuate the generational transfers of arcane knowledge that is used to keep the ordinary people in political, economic and spiritual bondage to the oldest bloodlines on earth. Ninety percent of the people in this group will live and die without having pierced the fifth veil.
The fifth veil: Ten percent of us will pierce the fifth veil to learn that the secret societies are so far advanced technologically that time travel and interstellar communications have no boundaries and controlling the actions of people is what their members do as offhandedly as we tell our children when they must go to bed. Ninety percent of the people in this group will live and die without having pierced the sixth veil.
The sixth veil: Ten percent of us will pierce the sixth veil where the dragons and lizards and aliens we thought were the fictional monsters of childhood literature are real and are the controlling forces behind the secret societies. Ninety percent of the people in this group will live and die without piercing the seventh veil.
The seventh veil: I do not know what is behind the seventh veil. I think it is where your soul is evolved to the point you can exist on earth and be the man Ghandi was, or the woman Peace Pilgrim was-people so enlightened they brighten the world around them no matter what.
The eighth veil? Piercing the eighth veil probably reveals God and the pure energy that is the life force in all living things-which are, I think, one and the same.
If my math is accurate there are only about 60,000 people on the planet who have pierced the sixth veil. The irony here is too incredible: Those who are stuck behind veils one through five have little choice but to view the people who have pierced the veils beyond them as insane. With each veil pierced, exponentially shrinking numbers of increasingly enlightened people are deemed insane by exponentially increasing masses of decreasingly enlightened people.
Adding to the irony, the harder a “sixth or better veiler” tries to explain what he is able to see to those who can't, the more insane he appears to them.
Our enemy, the state
Behind the first two veils we find the great majority of people on the planet. They are tools of the state: Second veilers are the gullible voters whose ignorance justify the actions of politicians who send first veilers off to die in foreign lands as cannon fodder -- their combined stations in life are to believe that the self-serving machinations of the power-elite are matters of national security worth dying for.
Third, fourth, fifth and sixth veilers are of increasing liability to the state because of their decreasing ability to be used as tools to consolidate power and wealth of the many into the hands of the power-elite. It is common for these people to sacrifice more of their relationships with friends and family, their professional careers and personal freedom with each veil they pierce.
Albert Jay Nock (1870-1945), author of “Our Enemy, the State” (1935), explained what happens to those who find the seventh and eighth veils: “What was the best that the state could find to do with an actual Socrates and an actual Jesus when it had them? Merely to poison one and crucify the other, for no reason but that they were too intolerably embarrassing to be allowed to live any longer.”
Conclusions
And so now we know that it's not that our countrymen are so committed to their lives that, “they don't want to see,” the mechanisms of their enslavement and exploitation. They simply “can't see” it as surely as I cannot see what's on the other side of a closed curtain.
The purpose of this essay is threefold: To help the handful of people in the latter veils to understand why the masses have little choice but to interpret their clarity as insanity; 2. To help people behind the first two veils understand that living, breathing and thinking are just the beginning and; 3. Show people that the greatest adventure of our life is behind the next veil because that is just one less veil between ourselves and God.

Google Glass and face recognition software: the spys will soon be everywhere you go and it all goes back to Deep Black Servers
Amid growing privacy concerns and repeated statements from Google that its futuristic wearable computer can’t recognize faces, a California software developer has done just that, releasing facial recognition software for Google Glass.
Lambda Labs software lets anyone wearing Google Glass look up faces in a crowd against a computer database, instantly showing someone’s name and any other vital bits of data contained in the app. And even the app developer acknowledges the implications for privacy.
“We have no plans to provide a global facial recognition database,” Stephen Balaban, founder of Lambda Labs, told FoxNews.com. “That’s probably not a good idea.”
Instead, Balaban’s technology is an API intended to allow other software developers working with early versions of Glass to write their own apps.

Is a $400,000 house with NINJA loan normal?
How about a $200,000 REO with missing appliances, a dead yard, a long list of maintenance and no financing?
Maybe normal is a $300,000 flip after the flipper fixed everything and colored up the yard, and did some upgrades to the interior.
Some may suggest that normal is more like a $300,000 sale with a 5.5% fixed rate and 20% down.
Then again, it may be more normal if this $300,000 sale is financed with a 3.5% down FHA loan at 4%.
Of course, all of the above is actually referring to the same house.
So what is normal? Analysts and economists have long accepted household formation, population and job creation as the basis for housing supply and demand. There was a study (I can't seem to locate) that showed that there is no correlation whatsoever. I am going to borrow a chart from my cyber friend Calculated Risk as an illustration:

I think I am going to leave it to the Wharton grads to explain how population and employment fit into the above erratic housing starts chart. In fact, if you use employment as a factor, then we should be tearing down a few million houses since we have lost about 6-7 million jobs since the great recession. If population is a factor, then I suggest you invest in Cairo where the population is definitely growing much faster than that of Silicon Valley.
Is it normal that Wall Street is buying up all these houses? Wall Street OPM ('other people's money') is not only buying up all existing homes, now it is squeezing out the buyers for new homes as well. The numbers work exactly the same way for new and existing homes. The builders would far prefer a no-contingency cash offer with no commissions, no lender fees and no marginal buyers that they have to coach into qualifying. In other words, builders can take a lower offer from Wall Street and still be as profitable as when they are selling to mom and pop.
Is this good housing policy? Of course not. Where are the policy makers? Just like Greenspan during the sub-prime era, Bernanke is like a deer frozen in the headlights. He is busy with his QEs and claiming there is a housing recovery, while he should actually be busy writing his memoirs entitled: "I did not see it coming."
So what is normal? Logically, the past is only relevant if conditions in the future are expected to be similar. We know that with aging baby boomers, housing demand will be substantially different than when the same boomers were at the peak of their productive years. Should the demand rather be for duplex type constructions or grannie flats, as the boomers try to juggle taking care of elderly parents and boomerang kids?
Current economic conditions should also present a different outlook. For example, with youth unemployment so high, with student loans in the trillions, there is no reason why first time home purchases should not be delayed. It seems to me the worst thing policy makers can do is to give this group even more credit, especially long term credit like a 30 year mortgage that will entrap them forever.
However, I believe the new normal is going to be intervention. Here is a recent speech by Fed Governor Elizabeth Duke, entitled "A View from the Federal Reserve Board: The Mortgage Market and Housing Conditions"
This speech is significant because Duke usually labels herself as the Federal Reserve's main voice on housing.
Since joining the Board in 2008 amid a crisis centered on mortgage lending, I have focused much of my attention on housing and mortgage markets, issues surrounding foreclosures, and neighborhood stabilization.
For those who follow the housing market, I believe this speech is a must read. It provides insight into the data that the Fed is looking at and the Fed's understanding, or misunderstanding, of the real estate market. They seem to be overly concerned about lending to borrowers with low credit scores (emphasis mine):
“The drop in originations has been most pronounced among borrowers with lower credit scores. For example, between 2007 and 2012, originations of prime purchase mortgages fell about 30 percent for borrowers with credit scores greater than 780, compared with a drop of about 90 percent for borrowers with credit scores between 620 and 680 (figure 6).5 Originations are virtually nonexistent for borrowers with credit scores below 620…

At the Federal Reserve, we continue to foster more accommodative financial conditions and, in particular, lower mortgage rates through our monetary policy actions. We also continue to monitor mortgage credit conditions and consider the implications of our rule makings for credit availability. For your part, I urge you to continue to develop new and more sustainable business models for lending to lower-credit-score borrowers that lead to better outcomes for borrowers, communities, and the financial system than we have experienced over the past few years.”
Governor Duke has completely forgotten about the sub-prime disaster. A low credit score is not a given, it is earned. A borrower must carry some balance, miss a few payments or even default on a few loans before they can garner a 620 or lower credit score. The last thing that sub-prime borrowers need is more debt, something that they have proven they cannot manage.
At the moment, we know prices are going up in certain markets, and so are sales. Mortgage rates are higher now than when QE3 started in September 2012. Investors are gobbling up everything in sight in their favored target markets. As an example, they are buying 30% of the houses in Southern California, 38% in Phoenix and 53% in Vegas. Do The Many Really Have to Obey the Few? Asking Permission From the Government

I remember in grade school that some of the boys in class were being disruptive by talking and the nun told us all to stand and put out our hands so she could smack our hand with a ruler. About half the class stood up and put out their hand but when they saw that the rest of us were still sitting at our desks they slowly sat back down. The bewildered nun didn’t know what to do and finally told us to open our books.
That’s what happens when a person in authority threatens you and you all stand up to them. They expect you to obey and when you don’t they back down. In other words, they are nothing more than the school yard bully.
The government is so out of control and making laws that are insane. People are now being fined for the simplest things. Remember the slogan, “Buckle Up – It’s the Law”. You can be fined for not wearing a seatbelt in your own car. You can be fined for using a rain barrel to save water to irrigate your small garden in the back yard; you can be arrested for selling raw milk which has been a staple for thousands of years. You can be fined or arrested for photographing the police abusing someone and your camera confiscated. The government mandates you get vaccines for your babies and children when legitimate research tells you it is harmful. A woman was fined $81 for parking her car with the windows rolled down. The police classified it as an unsecured vehicle that could easily be broken into. Another woman was recently fined for growing a small garden in her front yard. What would happen if we all planted a small garden in our front yard? Actually, that might not be a bad idea. We would have some GM free veggies. Are you really going to obey these ridiculous rules or laws? If you do they will keep adding more.
The elite think they can rule you by starting out slowly. I’m sure you’ve heard the story of putting a frog in a pan of lukewarm water and then slowly heating it up and the frog doesn’t realize that he is being boiled alive until it’s too late to get out of the pot. Mostly that’s what the government does to us. First one license or fine which they got away with, then another, then another, and now we have well over a hundred different licenses we are required to obtain and fines we are expected to pay. Another manner in which the government controls you is by fear.
The government tells us the laws are for our safety. They won’t label GM food because they know it will harm your health; even the wild animals won’t eat it; rats fed Monsanto GM corn developed shockingly large cancer tumors. They add sodium fluoride to our water and to our toothpaste which is a rat poison; they fill our skies with chemicals, they fill the atmosphere with all sorts of radiation including cell phone towers. If they are for our safety, why do they hide many of those health-threatening cell phone towers in trees, and church steeples and crosses, water towers, and schools? I’ve even seen them in palm trees. Churches and schools love these because they generate big bucks. Dr. Mercola (certified network asset for the covens) states on his website:
As school budgets shrink, some are getting money from an unlikely and controversial source: cell phone tower installations. Local schools can make hundreds of thousands of dollars from leases on towers.
Why did you get a marriage license? Most people get one because everyone else does; it’s the norm; it’s the law. My research showed the first marriage license was issued in 1856 in Shawnee, Kansas. So since the beginning of recorded time it was the norm to marry without a license until 1856.
Were Adam & Eve married? Did Adam & Eve need a license, the authorization of some man or government? It is plain to see that God recognizes a couple as married when they “cleave unto” each other. Genesis 2:23-24 (not when a government gives them a license/permission).
Did you know there are Pastors who will marry without a marriage license and they are more common than you think? All you have to do is go online or open up your local phone book and call the numbers in the churches section. Sooner or later you will find a man of God who hasn’t sold his soul applying for a 501(c) corporate status with the IRS and who believes that there ought to be a separation between church and state and marriage and state.
Pastor Trewhella of the Mercy Seat Christian Church in Wisconsin stated;
“You should not have to obtain a license from the State to marry someone anymore than you should have to obtain a license from the State to be a parent, which some in academic and legislative circles are currently pushing to be made law”. ~ mercyseat.net/marriagelicense.html
When Pastor Trewhella marries a couple, he always buys them a Family Bible which contains birth and death records, and a marriage certificate. Record the marriage in the Family Bible. What’s recorded in a Family Bible will stand up as a legally binding document in any court of law in America. Both George Washington and Abraham Lincoln were married without a marriage license. They simply recorded their marriage in their Family Bibles. So should we. What happens if no one acquires a marriage license from the government? Well, outside of the obvious, we wouldn’t have to ask permission from the government to get a divorce.
If every American refused to obey these insane laws what will the elite do? The same thing as the nun or the school yard bully when not obeyed – brute force and if that doesn’t work, they will back down. Just like the schoolyard bully who takes your lunch money every day. A day comes when you tell him “no” and he beats you up. You don’t give him your lunch money the next day and he beats you up again. Then he looks for someone else who will ‘obey’ him. Where would that school yard bully be if no one gave him their lunch money? Where would the government be if no one asked for permission and never got another license or paid another fee or fine?
Let me clarify what a license or permit is. It is simply asking permission from the government and paying the government a fee for what we have every God-given right to do in the first place – for free, without asking anyone for permission. Burn that statement into your mind. Memorize it, use it as a chant. If that’s not bad enough, we must renew many licenses’ periodically and pay again and again. What if we all decided we would no longer get or renew our driver’s license and pay them for the right to drive our own car? What if we all stopped getting a license of any kind? They could fine us. But what if we didn’t pay the fine? We might go to jail. Where do a few get off telling the many we can’t get married, defend ourselves, or drive a car or go fishing or hunting or any of our other God-given rights without their permission? I don’t need the government to give me permission to purchase a gun to defend myself. Why aren’t you outraged? Just because you grew up under these insane rules and you accepted them as normal you don’t have to obey them anymore. They aren’t normal; they’re insane; you are obeying insane laws. You don’t have to stand up and put your hand out so the nun can whack it with a piece of wood or give your lunch money to the school yard bully anymore. Like the frog, you’re slowly being boiled.
Every permit, every license, and every birth certificate has a number on it. You even have a social security number. Have you ever asked why you and everything you do has a number on it? It’s to keep track of you, what you do, where you do it and when you do it. If you move you have to notify various government agencies of your new address. Why is that? Why isn’t just notifying the post office of a change of address enough?
Why can the government get away with these insane laws and fines? For several reasons. You do what you’re told because you believe it to be the norm; it’s what everyone else does. There is a story about two frogs hopping down a country road and they happen to hop into a bucket of fresh milk. They begin thrashing about and swimming in the milk and the older one got really tired and gave up and died. The younger one kept on swimming until he felt something solid under his feet and hopped out. (No, it wasn’t the body of the dead frog!) He thrashed so much and so long he turned the milk into butter.
The moral of the story is “there are butter days ahead”…if we all decide NOT to OBEY.
If we all stop obeying these insane rules the government places upon us, there will be better days ahead with true freedom, but you gotta fight for it by being passive – by not obeying – by not applying for anymore licenses and paying them a fee and obeying them. Freedom is not going to come softly in the night while you sleep. Don’t leave it for the “other” guy. Remember, you are the “other” guy to everyone else.

I remember in grade school that some of the boys in class were being disruptive by talking and the nun told us all to stand and put out our hands so she could smack our hand with a ruler. About half the class stood up and put out their hand but when they saw that the rest of us were still sitting at our desks they slowly sat back down. The bewildered nun didn’t know what to do and finally told us to open our books.
That’s what happens when a person in authority threatens you and you all stand up to them. They expect you to obey and when you don’t they back down. In other words, they are nothing more than the school yard bully.
The government is so out of control and making laws that are insane. People are now being fined for the simplest things. Remember the slogan, “Buckle Up – It’s the Law”. You can be fined for not wearing a seatbelt in your own car. You can be fined for using a rain barrel to save water to irrigate your small garden in the back yard; you can be arrested for selling raw milk which has been a staple for thousands of years. You can be fined or arrested for photographing the police abusing someone and your camera confiscated. The government mandates you get vaccines for your babies and children when legitimate research tells you it is harmful. A woman was fined $81 for parking her car with the windows rolled down. The police classified it as an unsecured vehicle that could easily be broken into. Another woman was recently fined for growing a small garden in her front yard. What would happen if we all planted a small garden in our front yard? Actually, that might not be a bad idea. We would have some GM free veggies. Are you really going to obey these ridiculous rules or laws? If you do they will keep adding more.
The elite think they can rule you by starting out slowly. I’m sure you’ve heard the story of putting a frog in a pan of lukewarm water and then slowly heating it up and the frog doesn’t realize that he is being boiled alive until it’s too late to get out of the pot. Mostly that’s what the government does to us. First one license or fine which they got away with, then another, then another, and now we have well over a hundred different licenses we are required to obtain and fines we are expected to pay. Another manner in which the government controls you is by fear.
The government tells us the laws are for our safety. They won’t label GM food because they know it will harm your health; even the wild animals won’t eat it; rats fed Monsanto GM corn developed shockingly large cancer tumors. They add sodium fluoride to our water and to our toothpaste which is a rat poison; they fill our skies with chemicals, they fill the atmosphere with all sorts of radiation including cell phone towers. If they are for our safety, why do they hide many of those health-threatening cell phone towers in trees, and church steeples and crosses, water towers, and schools? I’ve even seen them in palm trees. Churches and schools love these because they generate big bucks. Dr. Mercola (certified network asset for the covens) states on his website:

Why did you get a marriage license? Most people get one because everyone else does; it’s the norm; it’s the law. My research showed the first marriage license was issued in 1856 in Shawnee, Kansas. So since the beginning of recorded time it was the norm to marry without a license until 1856.
Were Adam & Eve married? Did Adam & Eve need a license, the authorization of some man or government? It is plain to see that God recognizes a couple as married when they “cleave unto” each other. Genesis 2:23-24 (not when a government gives them a license/permission).
Did you know there are Pastors who will marry without a marriage license and they are more common than you think? All you have to do is go online or open up your local phone book and call the numbers in the churches section. Sooner or later you will find a man of God who hasn’t sold his soul applying for a 501(c) corporate status with the IRS and who believes that there ought to be a separation between church and state and marriage and state.
Pastor Trewhella of the Mercy Seat Christian Church in Wisconsin stated;

When Pastor Trewhella marries a couple, he always buys them a Family Bible which contains birth and death records, and a marriage certificate. Record the marriage in the Family Bible. What’s recorded in a Family Bible will stand up as a legally binding document in any court of law in America. Both George Washington and Abraham Lincoln were married without a marriage license. They simply recorded their marriage in their Family Bibles. So should we. What happens if no one acquires a marriage license from the government? Well, outside of the obvious, we wouldn’t have to ask permission from the government to get a divorce.
If every American refused to obey these insane laws what will the elite do? The same thing as the nun or the school yard bully when not obeyed – brute force and if that doesn’t work, they will back down. Just like the schoolyard bully who takes your lunch money every day. A day comes when you tell him “no” and he beats you up. You don’t give him your lunch money the next day and he beats you up again. Then he looks for someone else who will ‘obey’ him. Where would that school yard bully be if no one gave him their lunch money? Where would the government be if no one asked for permission and never got another license or paid another fee or fine?
Let me clarify what a license or permit is. It is simply asking permission from the government and paying the government a fee for what we have every God-given right to do in the first place – for free, without asking anyone for permission. Burn that statement into your mind. Memorize it, use it as a chant. If that’s not bad enough, we must renew many licenses’ periodically and pay again and again. What if we all decided we would no longer get or renew our driver’s license and pay them for the right to drive our own car? What if we all stopped getting a license of any kind? They could fine us. But what if we didn’t pay the fine? We might go to jail. Where do a few get off telling the many we can’t get married, defend ourselves, or drive a car or go fishing or hunting or any of our other God-given rights without their permission? I don’t need the government to give me permission to purchase a gun to defend myself. Why aren’t you outraged? Just because you grew up under these insane rules and you accepted them as normal you don’t have to obey them anymore. They aren’t normal; they’re insane; you are obeying insane laws. You don’t have to stand up and put your hand out so the nun can whack it with a piece of wood or give your lunch money to the school yard bully anymore. Like the frog, you’re slowly being boiled.
Every permit, every license, and every birth certificate has a number on it. You even have a social security number. Have you ever asked why you and everything you do has a number on it? It’s to keep track of you, what you do, where you do it and when you do it. If you move you have to notify various government agencies of your new address. Why is that? Why isn’t just notifying the post office of a change of address enough?
Why can the government get away with these insane laws and fines? For several reasons. You do what you’re told because you believe it to be the norm; it’s what everyone else does. Pilot had passenger detained for not flushing toilet

A passenger who flew from Philadelphia to San Francisco was detained on arrival by federal agents after a vindictive flight attendant claimed he had not flushed a lavatory toilet, according to a federal suit.
The suit, which seeks $500,000 in damages, was filed last week in the Northern District of California.
Salvatore Bevivino, 52, a business manager for Genentech, boarded a Virgin America flight on April 28, 2012. After the plane reached cruising altitude over Indiana, the former Amblerite pushed the call button and asked for a soda.
According to the suit, a male attendant told Bevivino that if he wanted a drink he would have to use a computer touch screen installed on the back of the facing seat.
When another attendant passed a minute later, Bevivino made the request for a second time and asked why they couldn't deliver a drink like other airlines. After Bevivino said he would contact Virgin America, a third attendant brought him the soda.
The aircraft landed at San Francisco International. But as Bevivino began to disembark he was pulled aside by the plane's captain "as a person of suspicion."
Bevivino said he had no idea why he was detained. Initially he believed that his swarthy Italian complexion may have caused him to be mistaken for someone from the Middle East.
Then the pilot asked him why'd he'd been yelling obscenities at his crew.
And added that he'd left the toilet unflushed.
The pilot then asked a half-dozen uniformed police, FBI and TSA agents to remove Bevivino.
According to a police incident report, a flight attendant told an investigator that Bevivino had gone to the restroom after asking for the drink:
"[He] came back out with a smile on his face and began using profanities. [Name redacted] passed by the restroom and saw that Bevivino left the door open and did not flush the toilet."
The police report notes the captain didn't believe he or his flight crew ever felt threatened by Bevivino.
Bevivino, who now lives in the Bay Area, told police he had not yelled obscenities at anyone or left any toilet unflushed. He only had been trying to order a drink, was flustered with problems with the onboard computer, and had become frustrated when the flight attendant ignored him, according to the police report.
Bevivino was eventually released, but only after the incident had caused him embarrassment, humiliation, mortification, mental anguish and emotional distress, and damage to his professional reputation, according to the suit.
The complaint states that Virgin America violated Bevivino's civil rights through false imprisonment, discrimination, and denial of equal rights.

New law will ban protesters from riding mass transit in California
Risking arrest isn’t the only obstacle for Northern California protesters — under a new rule about to go into effect, political demonstrators could lose their right to ride public transportation.
Starting next week, law enforcement officers policing the Bay Area Rapid Transit (BART) system in San Francisco, Sacramento, Oakland and other cities can issue bus and subway bans for unruly passengers — and according to one local news report, that power could be used to prevent political protesters from getting to demonstrations or essentially going anywhere.
Under the recently passed State Assembly Bill 716, BART can issue “prohibition” orders to any passenger cited or arrested for certain offenses, essentially blacklisting some people from boarding public transit vehicles if they’ve been charged with certain crimes.
BART Board President Tom Radulovich told Bay City News the law is “an important safety initiative to keep our employees and riders safe,” adding, “We’re very concerned that for the past few years folks have been assaulting our station agents.”
"We are really wanting to send the message that if you are going to come onto our system and be unruly or violent, there are going to be consequences,” BART spokesperson Alicia Trost told local ABC affiliate KGNO News.
But while the new bill will provide BART police the authority to immediately revoke riding privileges for persons arrested or convicted of acts involving violence, threats of violence, lewd or lascivious behavior or possession or sale of drugs on area transit, those charged with minor infractions could be targeted too. “AB 716 won't only target violent behavior,” KGNO reported. “It can be applied to protestors who have been arrested during free-speech movements.”
The law will allow for prohibition orders to be issued on-the-spot if a person is just once arrested or convicted for a misdemeanor or felony involving lewd, violent or drug-related acts in a BART zone, but passengers cited three or more times for minor infractions in just as many months are subject to the ban as well.
Under the bill, a transit district may issue a prohibition order to any person charged with violating a number of local statutes, including Section 640 of state Penal Code — the law that goes after riders accused of “Willfully disturbing others on or in a system facility or vehicle by engaging in boisterous or unruly behavior” and those “Willfully blocking the free movement of another person in a system facility or vehicle.”
Although the official statute includes a note from the state declaring that Section 640 “shall not be interpreted to affect any lawful activities permitted or First Amendment rights protected under the laws of this state or applicable federal law,” allowing BART officers to ban users even accused by law enforcement of a misdemeanor could disenfranchise a huge percentage of their rider base and has critics already warning of potential authoritarian overreach.
"Certain instances have happened over the years that have caused some tragic things to happen, but you got to be careful who your profile," BART passenger Kadmiel McCrory told KGNO.
Indeed, one doesn’t have to look too deep to divulge instances of arguable overreach in not just the Bay Area but on the BART system as well. On the morning of January 1, 2009, BART Officer Johannes Mehserle fatally shot an unarmed, 22-year-old passenger, Oscar Grant, on an Oakland train platform. The killing of Grant remains a highly contested issue among Bay Area residents, and has spawned a number of large protests impacting the BART system, including a November 2010 demonstration that led to 152 arrests. Then in July 2011, BART police shot and killed another passenger — a mentally ill homeless man name Charles Blair Hill — who is alleged to have thrown a knife at an officer. The response that occurred as a result can easily be considered a precursor to enacting AB 716.
Following the 2011 shooting death of Hill, BART passengers orchestrated a massive protest that made national headlines thanks in part to the involvement of Internet hacktivist group Anonymous. A rally for Hill days after his death began peacefully but ended in violence and at least three dozen arrests. When a second protest was planned the following month, BART officials responded by having cell phone service shut down in four separate train stations to prevent demonstrators from coordinating their actions.
"We're going to take steps to make sure our customers are safe," BART spokesman Jim Allison said in a statement that August. "The interruption of cell phone service was done Thursday to prevent what could have been a dangerous situation. It's one of the tactics we have at our disposal. We may use it; we may not. And I'm not sure we would necessarily let anyone know in advance either way."
Although that protest never materialized as planned, Anonymous responded by leaking the names, passwords and other identifying information for more than 2,000 customers of a BART-affiliated website, announcing in a statement, “we will not tolerate censorship.”
“Anonymous demands that this activity revolving around censorship cease and desist and we know you are already planning to do this again," the hacktivists wrote. The Electronic Frontier Foundation and American Civil Liberties Union opposed the decision to throttle cell service as well.
Now with AB 716 going into effect, protesters may once again find they are unwelcome to ride on the fifth-busiest heavy rail rapid transit system within the United States. Accumulating only three easy-to-obtain infractions in just 90 days can cause a prohibition order to be issues, and when the law goes into effect on Monday, BART officers will actually be provided with the names and photographs of prohibited individuals in order to keep them from riding mass transit, BART police Chief Kenton Rainey told the San Francisco Appeal. According to Rainey, officers’ computers will contain information about active orders, and any persons picked up or cited on the BART system for new crimes can be matched against the database to see their status.

Although that protest never materialized as planned, Anonymous responded by leaking the names, passwords and other identifying information for more than 2,000 customers of a BART-affiliated website, announcing in a statement, “we will not tolerate censorship.”

Accumulating only three easy-to-obtain infractions in just 90 days can cause a prohibition order to be issues, and when the law goes into effect on Monday, BART officers will actually be provided with the names and photographs of prohibited individuals in order to keep them from riding mass transit, BART police Chief Kenton Rainey told the San Francisco Appeal. According to Rainey, officers’ computers will contain information about active orders, and any persons picked up or cited on the BART system for new crimes can be matched against the database to see their status.
